1. Acceptance of Terms
By accessing our website, submitting an order request, or purchasing products from Kaylin Cakes, LLC (“Kaylin Cakes,” “we,” “us,” or “our”), you (“Customer” or “you”) agree to be bound by these Terms & Conditions. If you do not agree, please do not use our services or website.
These Terms are governed by the laws of the State of Tennessee and applicable federal law of the United States of America.
2. Cottage Food Law Compliance
Kaylin Cakes, LLC operates as a cottage food business under the Tennessee Homemade Food Freedom Act (T.C.A. § 53-8-101 et seq.). By placing an order, you acknowledge and agree that:
- All baked goods are produced in a home kitchen that has not been inspected by the Tennessee Department of Health or any state regulatory agency.
- Products are sold directly from the baker to the consumer and are not intended for resale.
- Each product will be labeled in compliance with Tennessee cottage food labeling requirements, including the statement: “This product was made in a home kitchen that is not inspected by the Tennessee Department of Health.”
- You are purchasing with full knowledge and understanding of the cottage food nature of these products.
3. Custom Order Requirements
All products offered by Kaylin Cakes are made to order. Order acceptance is subject to baker availability and capacity at the time of request.
Order lead time: All orders must be placed at least one (1) week in advance of the requested delivery or pickup date. Orders submitted with less than one week’s notice may be declined at the baker’s discretion.
An order is not confirmed until you receive written confirmation from the baker via email or text message. Submitting an order request form does not constitute a binding agreement until confirmed.
The baker reserves the right to decline any order request for any reason, including but not limited to scheduling conflicts, ingredient availability, or design complexity.
4. Pricing
All prices displayed on our website are estimates only and are subject to change. Final pricing will be confirmed by the baker in your order confirmation message. Pricing may vary based on custom design requests, ingredient costs, delivery distance, or special accommodations.
A $10 delivery fee applies to all delivered orders. Delivery is available within 20 miles of Nashville, Tennessee. Orders outside this radius may be subject to additional fees or declined.
Prices are in U.S. dollars and inclusive of all applicable costs unless otherwise stated in your confirmation.
5. Payment
Payment is due prior to or upon delivery of your order unless otherwise arranged with the baker. Accepted payment methods include cash, Venmo, Cash App, and Zelle, as communicated at time of confirmation. Failure to submit payment by the agreed deadline may result in order cancellation.
We do not store credit card or debit card information. All digital payments are processed through third-party platforms subject to their own terms and privacy policies.
6. Cancellation Policy
- Cancellation 72+ hours before the delivery date: Full refund or credit toward a future order, at the baker’s discretion.
- Cancellation within 48–72 hours of delivery: 50% refund, as ingredients and preparation may already be underway.
- Cancellation within 48 hours of delivery: No refund. The order may still be fulfilled and payment is owed in full.
- Cancellation by the baker: If the baker must cancel due to unforeseen circumstances (illness, emergency, etc.), you will receive a full refund or the option to reschedule at no additional charge.

7. Refund Policy
Due to the custom, perishable, and cottage-food nature of our products, all sales are generally final. Refunds or replacements may be issued at the baker’s sole discretion in the following circumstances:
- The product was significantly different from what was confirmed in writing
- The product was damaged during delivery due to our handling
- The order contained a confirmed error on the baker’s part
To request a refund or replacement, you must notify us within 24 hours of delivery with a written description and photographs of the issue. Refund claims submitted after this window will not be honored.
Refunds will not be issued for changes in personal taste preferences, minor aesthetic variations inherent to handmade products, or issues caused by improper handling after delivery.
8. Allergen Disclaimer
All products are made in a home kitchen that handles common food allergens including but not limited to: milk, eggs, wheat (gluten), soy, peanuts, and tree nuts. While we take careful precautions to prevent cross-contamination, including thorough cleaning of equipment, we cannot guarantee a completely allergen-free environment.
Gluten-free options are available for select items. Customers with severe food allergies or celiac disease assume all risk associated with consuming our products. By placing an order, you acknowledge this risk and release Kaylin Cakes, LLC from any liability arising from allergen exposure.
It is your responsibility to disclose any known allergies at the time of ordering. We will make every reasonable effort to accommodate your needs and will inform you if we cannot safely do so.
9. Delivery Terms
Delivery is available within 20 miles of Nashville, Tennessee. A confirmed delivery date and time window will be communicated in your order confirmation. You or a designated recipient must be available to receive the order at the agreed time.
If no one is available to receive the order at the agreed time and location, the baker may leave the product in a safe location at their discretion. We are not responsible for product condition after a delivery attempt has been made.
Risk of loss and title for all products pass to you upon completion of delivery. We are not responsible for product damage caused by improper storage or handling after delivery.
10. SMS and Email Opt-In Program Terms
By opting in to one of our SMS programs (at order checkout or on our contact form), or to our email program at checkout or through our contact form, you agree to receive messages from Kaylin Cakes, LLC as described in our Privacy Policy. Each SMS opt-in covers a single use case; consenting to one does not enroll you in the other.
SMS Program 1 — Order Alerts (opt-in at checkout):
- Program description: Recurring transactional SMS messages regarding your order only — order confirmations, status updates, and pickup/delivery coordination
- Message and data rates may apply
- Message frequency varies — no more than 4 messages per month
- Reply STOP to cancel at any time; reply HELP for help
- Consent to receive SMS messages is not a condition of any purchase
SMS Program 2 — Customer Support Replies (opt-in on our contact form):
- Program description: Recurring SMS messages replying to an inquiry you submit through our contact form — responses and follow-up needed to answer or resolve that inquiry only. No marketing or promotional content.
- Message and data rates may apply
- Message frequency varies — no more than 4 messages per month
- Reply STOP to cancel at any time; reply HELP for help
- Consent to receive SMS messages is not a condition of any purchase

Email Program:
- You may unsubscribe at any time via the link in any marketing email
- Transactional emails related to your order are not subject to opt-out
- Consent to receive marketing emails is not a condition of any purchase
Both programs comply with the TCPA (47 U.S.C. § 227), the CAN-SPAM Act of 2003, and CTIA Messaging Principles and Best Practices.
11. Intellectual Property
All content on this website, including but not limited to text, graphics, photographs, logos, and design elements, is the property of Kaylin Cakes, LLC or its content suppliers and is protected by applicable US copyright and trademark laws.
You may not reproduce, distribute, modify, or create derivative works from any content on this website without express written permission from Kaylin Cakes, LLC .
Custom cake designs created by Kaylin Cakes remain the intellectual property of the baker and may be used for portfolio and marketing purposes, including on social media, unless you request otherwise in writing.
12. Disclaimer of Warranties
Our website and services are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the website will be uninterrupted, error-free, or free of viruses or other harmful components. Pricing and product availability displayed on the website are subject to change without notice.
13. Limitation of Liability
To the fullest extent permitted by Tennessee law, Kaylin Cakes, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our products or services, even if advised of the possibility of such damages.
Our total liability to you for any claim arising under these Terms shall not exceed the total amount paid by you for the specific order giving rise to the claim.
14. Governing Law and Dispute Resolution
These Terms & Conditions are governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict of law provisions. You consent to the exclusive jurisdiction of the state and federal courts located in Davidson County, Tennessee for the resolution of any disputes.
Before initiating any legal action, you agree to contact us in good faith to attempt to resolve any dispute informally at tudorkaylin@gmail.com.
15. Changes to These Terms
We reserve the right to modify these Terms & Conditions at any time. Changes take effect immediately upon posting to this page with a revised effective date. Continued use of our website or services after changes are posted constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.
